Mediation
Mediation is a process in which an impartial third-party facilitates negotiations between the litigants. The goal of mediation is to help them reach a mutually acceptable settlement. The mediator does not make the decision that determines the outcome of the case. Rather, the parties – with the assistance of their attorneys – work with a mediator toward a solution with which they are comfortable.
Many of our attorneys are Court-Approved Mediators. As mediation attorneys, we handle a variety of cases privately and assigned by the courts and boast high settlement rates.
Mediation is often used to amicably resolve disputes between parties that have an ongoing business or personal relationship. Certain types of cases, which are particularly well suited to mediation, include commercial disputes, labor & employment matters, construction litigation disputes, product liability matters, environmental matters, certain general equity and probate cases, and divorce proceedings and other family disputes.
Arbitration
In contrast to mediation, arbitration is a process by which a neutral third-party or panel considers evidence presented by the parties and makes a decision which may be binding or non-binding, according to statute, rule, or the prior agreement of the parties.
Arbitration and mediation are useful in different situations. Arbitration is often successful in resolving commercial disputes and personal injury matters, as well as in negotiating labor & employment and construction disagreements.
Our alternative dispute resolution lawyers have extensive experience representing clients in mediation and arbitration proceedings. We are often sought after to act as the independent arbitrator in matters being handled by other law firms.
